TERMS AND CONDITIONS

These Terms and Conditions (“Agreement”) govern your participation in The Return, to be held at B Bar Ranch. By enrolling in or attending The Return, you (the “Participant”) agree to all of the following terms. If you do not agree to these terms, do not enroll or participate in the retreat.
1. Non-Refundable Payments and Travel Insurance
• All payments, including deposits, are non-refundable and non-transferable, regardless of circumstance.
• Travel insurance is required for all participants. It is your responsibility to secure a policy that covers cancellations, delays, medical emergencies, and other travel-related risks.
2. Acknowledgement of Risk and Release of Liability
By participating in The Return, including but not limited to yoga, massage, somatic practices, meditation, horse resonance, and trail rides, you acknowledge and accept the risks inherent in such activities. You affirm that:
• You are voluntarily participating and are in suitable health and physical condition.
• You accept full responsibility for any risk of injury, illness, or death that may arise from your participation.
• You release and hold harmless Tracey Bergrud, Olive Evans, The Return, B Bar Ranch, and their respective owners, employees, contractors, and agents from any and all liability, including claims of negligence.
3. Horse Trail Ride Terms
The optional 2-hour beginner walking trail ride is a sacred opportunity to integrate your retreat experience through connection with the wild landscape and the wisdom of the horses.
Participants must meet the following guidelines for safety:
• No prior experience is required, but participants must be in athletic shape.
• Long pants and closed-toed shoes are required.
• Hats must be secure; helmets are available.
• The ride proceeds rain or shine; rain gear is provided.
• Backpacks are not permitted on rides; small items may be stored in saddle bags.
• Snacks may be brought at the participant’s discretion.
Weight Limit Policy:
For the safety of riders and horses, we reserve the right to decline participation in the trail ride to any individual whose weight may negatively affect the horse. Excessive or unbalanced weight can cause permanent injury to horses and increases risk to the rider.
4. Use and Consent
You agree to abide by all terms of this Agreement, including privacy, consent, intellectual property, and media use.
• All content shared by The Return is proprietary.
• You may not reproduce, share, or distribute retreat materials without express written permission.
You grant permission for photographs, video, and audio recordings taken during the retreat that may include your likeness to be used for marketing and promotional purposes without compensation.
5. Assumption of Responsibility and Disclaimer
Participation in The Return is educational and experiential and does not constitute medical, psychological, or legal advice.
You assume full responsibility for your own physical, mental, emotional, and spiritual well-being before, during, and after the retreat.
6. Emergency Medical Authorization
In the event of an emergency, you authorize The Return and its facilitators to seek medical attention on your behalf. You accept full responsibility for any resulting medical expenses.
7. Communicable Disease Release
You acknowledge the ongoing risk of communicable diseases such as COVID-19. By attending the retreat, you assume full responsibility for your health and release The Return, its facilitators, and the B Bar Ranch from any liability related to illness or exposure.
8. Force Majeure
The Return shall not be held liable for failure to provide services due to causes beyond its control, including but not limited to natural disasters, acts of God, labor strikes, war, public health emergencies, or government restrictions. No refunds will be issued in such cases.
9. Behavior & Dismissal Clause
We reserve the right to remove any participant from the retreat without refund if their behavior is unsafe, disruptive, or not in alignment with the values of the retreat community.
10. Indemnification and Limitation of Liability
You agree to indemnify and hold harmless The Return, Tracey Bergrud, Olive Evans, and all retreat facilitators from any claims, damages, costs, or liabilities arising out of your participation.
11. Arbitration and Dispute Resolution
In the event of a dispute, you agree to resolve it through binding arbitration in the state of Montana. The prevailing party shall be entitled to attorney’s fees and costs.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Montana.
13. Agreement and Acknowledgment
By registering for The Return, you acknowledge that you have read, understand, and agree to these Terms and Conditions in full. You affirm that you are 18 years of age or older and are competent to consent.
